Intellectual Property Claim

Intellectual Property Claim Policy
Effective Date: March 1, 2025
At BetterShoes (operated by A Better Life Community Services LLC), we are committed to respecting the intellectual property rights of others and expect our users to do the same. If you believe that any content available on or through our website infringes your intellectual property rights, you may file a complaint by following the procedure outlined below.

A. Procedure for Reporting Intellectual Property Infringement

We enforce a strict policy to:

Remove or disable access to any content (including but not limited to text, images, or graphics) that we believe, in good faith, infringes upon the rights of others.
Suspend or terminate the accounts of users who are repeat infringers.

To submit a valid intellectual property infringement notice, your communication must include the following:

    1. Description of the Copyrighted Work: Clearly describe the copyrighted work or other intellectual property you believe has been infringed. Include any applicable registration numbers, if available.
    2. Details of the Infringing Material: Explain how the content violates your intellectual property rights and provide the exact URL(s) or location(s) on our website where the material can be found.
    3. Contact Information: Provide your full name, mailing address, phone number, and email address so we can follow up on your complaint.
    4. Good Faith Declaration: Include a statement confirming that you have a good faith belief the disputed use is not authorized by the IP owner, their agent, or the law.
    5. Accuracy and Authority Statement: Declare, under penalty of perjury, that the information you’ve provided is accurate and that you are the intellectual property owner or are authorized to act on their behalf.
    6. Signature: Include either an electronic or physical signature of the IP owner or an authorized representative.
Please submit your infringement notice to:
📧 Email: contact@bettershoes.info
📌 Subject Line: Intellectual Property Infringement Notice

B. Action Upon Receiving a Valid Notice

Once we receive a properly formatted and bona fide IP infringement notice, our policy is to:
  1. Promptly remove or disable access to the content in question
  2. Notify the content uploader (if applicable) of the removal
  3. Enforce repeat offender policies as needed

C. Counter-Notice Procedure

If you believe your content was mistakenly removed or disabled due to misidentification, you may file a counter-notice. Your notice should include the following information:

  1. Identification of the Removed Content: Provide the URLs or a clear description of the content and its location prior to removal.

  2. Good Faith Declaration: A statement made under penalty of perjury affirming that the content was removed due to an error or misidentification.

  3. Contact Information: Include your full name, mailing address, telephone number, and email address.

  4. Jurisdiction Consent: A statement indicating your agreement to the jurisdiction of the Federal District Court corresponding to your address.

  5. Signature: A physical or electronic signature.

Upon receiving a counter-notice, we may take the following actions:

  • Send the counter-notice to the original complainant

  • Inform them that the content may be restored within 10–14 business days unless they initiate legal proceedings

  • Reinstate the content at our discretion if no legal action is taken

Legal Notice – Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any individual who knowingly submits a false claim of infringement (or a false counter-claim) may be held liable for damages, including legal expenses and attorney’s fees.
